It's the most-asked crypto question in India, and the answer has been the same for years: crypto is legal, but not fully regulated. Here's what that means in practice.
The short answer
You can legally buy, hold, sell and transfer cryptocurrencies in India. Gains are taxed, exchanges must follow anti-money-laundering rules, and the government tracks transactions through TDS. What India doesn't have is a dedicated law that sets out how crypto businesses are licensed and supervised, or what protections investors get.
How India got here
- 2018: the RBI barred banks from serving crypto businesses, effectively cutting off rupee access.
- March 2020: the Supreme Court set aside the RBI's circular, restoring banking access for exchanges.
- 2021: a bill to ban most private cryptocurrencies was listed in Parliament but never introduced.
- April 2022: the 30% tax and, from July 2022, the 1% TDS took effect. Taxing crypto gave it an implicit legal footing.
- March 2023: crypto service providers were brought under the Prevention of Money Laundering Act and required to register with FIU-IND.
- 2023: during its G20 presidency, India pushed for a coordinated global approach to crypto.
- 2025–2026: a government discussion paper on crypto policy has been delayed repeatedly, with the RBI's caution cited as a key reason.
What "legal but unregulated" means for you
- You pay tax. Gains are taxed at 30% plus cess. See the crypto tax guide.
- KYC is mandatory. Registered exchanges must verify your identity with PAN and Aadhaar.
- Limited protection. There is no deposit insurance and no crypto ombudsman. If an exchange is hacked or fails, recovery can be slow, as WazirX users found.
- Choose registered platforms. See how to check FIU registration.
Can I pay with crypto in India?
Crypto isn't legal tender, so no one is obliged to accept it. A merchant may agree to, but spending crypto is a taxable transfer, and businesses have their own tax and reporting issues. The RBI's digital rupee (e₹) is legal tender, but it is not a cryptocurrency.
Could India still ban crypto?
A ban looks unlikely given that crypto is taxed, regulated for money laundering, and part of global regulatory discussions India has led. But the regulatory direction is not settled. Follow our updates in India's crypto regulation status.
